Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and RentasVIP ("Company," "we," "us," or "our") governing your use of the RentasVIP platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Description of Service

RentasVIP provides a property management software platform serving landlords, property managers, tenants, licensed realtors, and service contractors. Our services include property listing, tenant applications, online rent collection, maintenance request tracking, lease document storage, and related tools for rental property operations in South Florida.

User Accounts

Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Account Types

We offer different account types including Tenant, Landlord, Realtor, and Subcontractor accounts. Each account type has specific features and responsibilities. You may only register for the account type that accurately represents your role.

Account Termination

We reserve the right to suspend or terminate your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable federal, state, local, or international law
  • Post false, misleading, or fraudulent property listings
  • Discriminate against any protected class in violation of Fair Housing laws
  • Harass, abuse, or harm another person or entity
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated scripts to collect information or interact with the Service
  • Transmit viruses, malware, or other malicious code
  • Circumvent any access control or security measures
  • Use the Service for any commercial purpose not expressly permitted

Property Listings

If you list a property on RentasVIP, you represent and warrant that:

  • You have the legal right to list the property for rent
  • All listing information is accurate and not misleading
  • The property complies with all applicable housing codes and regulations
  • You will comply with all Fair Housing Act requirements
  • Photos and descriptions accurately represent the property
  • Stated rental prices and fees are accurate

We reserve the right to remove any listing that violates these Terms or applicable law.

Payments and Fees

Subscription Plans

RentasVIP offers subscription plans for property management services: Starter ($75/month), Professional ($99/month), Business ($125/month), and Realtor ($49/month). Annual billing is available with a 10% discount. All fees are quoted in U.S. Dollars and are subject to change with 30 days' notice.

Payment Processing

Payments are processed securely through Stripe. Charges will appear on your statement as 'RENTASVIP*PROPMGMT'. By making a payment, you agree to Stripe's terms of service. We do not store complete payment card information on our servers.

Rent Payments

Rent payments made through our platform are transactions between landlords and tenants. RentasVIP facilitates payment processing but is not a party to the lease agreement. Processing fees are disclosed at the time of payment.

30-Day Satisfaction Guarantee

New subscribers may request a full refund within 30 days of their first subscription payment. After 30 days, monthly subscriptions continue until cancelled with no partial refunds. Annual subscriptions are eligible for pro-rata refunds for remaining full months after the 30-day period.

Refunds & Cancellation

Intellectual Property

The Service and its original content, features, and functionality are owned by RentasVIP and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit to the Service (such as property photos and descriptions). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating and promoting the Service.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not verify the accuracy of property listings, user credentials, or tenant applications. Users are responsible for conducting their own due diligence.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTASVIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless RentasVIP and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved as follows:

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@rentasvip.com. We will attempt to resolve the dispute within 30 days.

Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.

Jurisdiction

Any legal action or proceeding shall be brought exclusively in the federal or state courts located in Miami-Dade County, Florida.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
